Horse Transport Terms & Conditions

Introduction

Please read these terms and conditions carefully before booking transport with us. By booking our services, you agree to these terms. If you have any questions, please contact us before confirming your booking.

1. Contract Formation

  • These terms apply to the hire of a horsebox and all services supplied by Fonture Transportation Ltd (“Owner”) to you (“Renter”). No contract exists until the Owner confirms your order in writing via post or email. Upon confirmation, a binding legal agreement is formed, governed by English law and subject to the exclusive jurisdiction of the English Courts. You are responsible for ensuring the accuracy of your order (including whether the horsebox is suitable for your needs) and for providing timely information and cooperation.

2. Description and Price of Hire Services

  • Details and pricing are as shown on our quotation or website at the time of order.
  • If the collection and return days are consecutive and the total period of use is under 24 hours, it will be charged as one day’s hire.
  • Your hire includes:
  • A signed rental agreement
  • 250 miles per day of hire (excess charged at 42p + VAT per mile)
  • Comprehensive vehicle insurance (terms available on request)
  • Vehicle theft protection
  • A full tank of fuel at collection
  • Full operational instructions
  • Pre-hire and return condition checks
  • 24-hour roadside relay (contact us in the event of breakdown)
  • Early collection is available from 6:00pm the evening before the hire date (by prior agreement only).

3. Extension of Rental Period

The Owner may agree to extend the rental. Any extension must be paid in full and agreed in writing. The maximum rental duration is three months.

4.Payments

  • Full payment is required at the time of booking to secure your hire. We no longer take deposits.
  • The horsebox will not be made available until full cleared payment is received.
  • If payment is not received, the horsebox may be re-hired without notice.
  • Payment may be made by debit/credit card or bank transfer.
  • By providing card details, you authorise Fonture to charge:
  • The full hire fee Additional mileage at 42p + VAT per mile Any fuel, cleaning, damage costs up to the excess of your hire or claims/offences.
  • Your own vehicle may be parked at our premises during the hire period at your own risk.
  • If the fuel tank is not returned full, the refuel cost plus a fee of £25 will be charged.
  • Damage must be reported to us in writing within 24 hours of occurrence.
  • In case of damage or loss:
  • You are liable for up to £1000 (insurance excess) An optional excess reduction fee of £20 incl. VAT is available prior to hire to reduce your excess to £500 Damage excludes fair wear and tear, which does not include scratches, tyre wear, upholstery damage, or mechanical faults.

5. Cancellation and Termination

  • You may cancel up to ten working days before hire or up to 48 hours prior to your booking with a veterinary certificate. After this, no refund will be given.
  • All cancellations must be in writing.
  • Refunds will be processed within 30 days (excluding any non-refundable fees).
  • If you request early termination of the contract, no refund will be issued.
  • We reserve the right to terminate the contract immediately if you breach the terms, and to recover any costs incurred.

6. Your Obligations

  • You shall not sell, assign, lease, or part with possession of the horsebox.
  • Notify us of any change of address and advise us of the horsebox’s location when requested.
  • Use all safety partitions for transporting animals. Animals must be properly secured.
  • Do not exceed manufacturer limits: max 2 horses, combined weight not to exceed 850kg.
  • Do not overload the vehicle.
  • Smoking is strictly prohibited in the horsebox.
  • Return the vehicle clean, full of fuel, and damage-free (as confirmed in the booking email).

7.Return of Horsebox

  • (a) On expiry or termination of the hire, return the horsebox to our premises, in clean and undamaged condition.
  • Late return fees are £300 per day (or part thereof).
  • Additional claims may be made if the late return results in cancellation of other bookings or damage to our business.
  • No refund or discount is given for early returns.

8. Breakdowns & Accidents

  • In the event of a breakdown, contact us immediately. Do not contact roadside recovery directly.
  • In case of accident:
  • Notify us within 24 hours

    Provide details of witnesses and any third parties

  • You agree to indemnify us against all losses not covered by insurance.

9 .Damage, Cleaning and Inspection

  • All vehicles will be inspected on return.
  • A cleaning surcharge of £50 will apply if the horsebox is returned in an unclean condition.
  • You will be charged for any damage, up to the excess or repair cost, whichever is lower.
  • Repairs will be assessed by an independent authorised horsebox specialist.

10. Legal Compliance & Offences

  • You are liable for any driving offences, tolls, or fines incurred during hire.
  • These may be passed on to you or charged to your payment method.

11. Data Protection.

  • Your data will be processed in accordance with the Data Protection Act. We may contact you about future services unless you opt out. You may request corrections or deletion of your data.

12. Indemnity

  • You agree to indemnify Fonture Transportation Ltd against any and all losses, damage, costs, or liabilities arising from your use of the horsebox or breach of these terms.

13. Ownership

  • The horsebox remains the sole property of Fonture Transportation Ltd. You have no rights over it other than as a renter. Any attempt to interfere with ownership or resale will result in legal action.

14. Force Majeure

  • We are not liable for delays or failure to perform arising from events outside our reasonable control, including weather, traffic, mechanical issues, or third-party service failures.

15. Amendments

  • We reserve the right to amend these terms for future hires. Notice of any changes will be given before your next booking.
